The Bell Video Mapping 2015


I thought it might be time for another airing of the video mapping project I made with the two Toms - Tom Chapman and Tom Lumens from Bristol. He did all the magic and I did all the boring stuff like research and sound clips, etc. Ironically, I was the only person involved who was not called Tom.

For anyone who hasn't seen it, it was a project focussing on the history of some of Bath's oldest pubs, and I am afraid to say that - of all the historic pubs in Bath - The Bell was the only one to actually do anything.

I see that the video has been hi-jacked by advertisers. I wonder if they can do that without my permission? Any legal advice would be gratefully received.

  1. Fantastic. I guess it's a compliment to have it hijacked but I'd be peed off in light of how much people can be paid to make these things. I'd say it is intellectual property theft.

  4. An American friend was contacted by Apple to ask for use and ownership of one of the photos he had posted on his blog. They paid him several thousand dollars and used it in a TV advert for the latest iPad.
    You could maybe start the conversation by suggesting a price but mention legal action. You never know, you might make a few quid.

  5. This is a fantastic video. I agree with Rachel, write a letter to document the infringement of copyright law. Be very specific on the infringement and list copyright law(s) violated.

  6. Thanks all, but I have a feeling that when you post up a video on YouTube (which is owned by Google) you relinquish all rights to your own material as far as income by advertising goes. They supply the platform, you supply the crap material, and they do whatever they want with it. It's a hard world for losers.

    1. The trouble is that each time you go to the video, it is a different company selling a different thing, so it must be You Tube selling the advertising space, which they are probably within their rights to do since I am not paying them to host the video.

      Despite what Rachel says, all this only occurred to me after I had put up this post.

    2. It’s also just occurred to me (honest) that the video belongs to Malibar Films in any case, so maybe she (Sarah Malibar) is making money from the adverts! I don’t have a leg to stand on!

  9. Wow, Tom, first time I saw it - and it is great!
    When I met you at the Bell I saw it was an old and time-honoured pub, but I didn't know it was that old. Thank you and the others for the beautiful and artistically informative video.

    As to the copyright of Google: that is what my son (judge) told me too when I entered blogland - my photos are no longer my own.
    Though I doubt it: when I do a photo with my cellphone: woosh, it is at that moment in the Google gallery on my cellphone (can't remember I (!!) installed that).

    But then: one can try to piss at the leg of a huge elephant, feeling like an ant in dimension. I did it once with the greatest publisher imperium of the world - and won (money wise) - though: who wins at the end (publishing wise) is not clear...

    I would try to find out
    a) who is the advertiser and
    b) did anyone sell them the video? Who? Google? Or did the advertisers just take it?

    After that one can start to think whom to fight, and if.

  10. That was very good. And yes YouTube are selling the ads which are part of the terms of your posting it - to be fair they don't charge you to host it. Not sure if you can get some revenue from it through... might require a very large number of views.
